Terms of service
These are the terms for buying any Clever Merchants service. We have kept them short and in plain English. Each offer page adds the specific scope, price, timeline and any guarantee for that package.
Last updated: 16 October 2026
1. Who we are
These terms are between you and Clever Merchants, run by Ger Devereux, Dublin, Ireland ("we", "us"). You can reach us at ger@clevermerchants.com. By paying for a service, you agree to these terms and to the description on the offer page you bought from.
2. Our services
Our services are fixed-scope packages. Each offer page describes what is included, the price, the timeline and any guarantee, and the version of that page on the day you pay is what we deliver. Anything not on that list is outside the package. If you want extra work, we will quote it separately and only start once you agree.
Where a package includes copy or changes to your website or profiles, we send them to you for approval before they go live, as the offer page describes.
3. Prices and payment
- Prices are shown on each offer page and on our pricing page, in the currency stated there. No VAT is added while Clever Merchants is not VAT registered.
- You pay in advance, by card, through Stripe. Work starts once payment has cleared.
- Monthly plans are paid in advance each month. You can cancel on 30 days' notice, unless the offer page sets a minimum first term.
- Fees charged by other providers, such as hosting, phone numbers, AI usage or advertising spend, are paid by you directly unless the offer page says they are included.
4. What we need from you
Most packages depend on access and information only you can give: for example user access to your website, Google Business Profile or Search Console, details about your business, and timely approvals. After you pay, we send an onboarding form that lists what we need.
- Timelines start when we have everything on that list, and pause while we are waiting for you.
- If something is missing, we will remind you. If we still do not have it 30 days after we first asked, we may close the project: we hand over the work that is complete, and any guarantee only covers the work we were able to do.
- No refund is due for work we could not do because access or information was not supplied, unless the offer page says otherwise.
- You are responsible for the accuracy of the information you give us, such as licence numbers, service areas and claims about your business.
5. Guarantees
Guarantees apply exactly as described on each offer page, and only to that package. For example, the 90-day citation guarantee on our GEO programmes is measured on 30 tracked prompts: if fewer than 3 prompts that did not name your business at the baseline do so 90 days after completion, we do one further round of work, up to 21 working days, at no extra cost. A guarantee is a promise of further work, not of money back, unless the offer page says otherwise. It depends on you having supplied the access we asked for and keeping our changes in place.
6. Refunds
We give refunds only where an offer page promises one, and on the terms it states. For example, the Visibility Fix pages offer a full refund at any point before the baseline sweep starts. Where an offer page makes no refund promise, fees are not refundable once work has started.
Our services are sold to businesses. If you buy as a consumer, nothing in these terms takes away your rights under Irish consumer law.
7. Who owns what
- You own your website content, your domain names and your accounts, including your website, Google Business Profile, Search Console, analytics and directory listings. Any new account we set up for you is created in your name or handed over to you when the work is done.
- Once you have paid, the pages, copy, schema and reports we make for you are yours to use as you wish.
- We keep our general methods, templates, tools and know-how, and may use them for other clients.
- We will not name you as a client or publish your results without your permission.
8. Results in AI tools and search
ChatGPT, Google, Perplexity, Copilot, Gemini and similar systems are run by other companies. They change their models, sources and answers often and without notice, so nobody can guarantee rankings, citations, traffic or enquiries. We promise to do the work described on the offer page to a professional standard, and to honour any guarantee exactly as stated there. Figures from past clients and case studies show what has happened before, not a promise of what will happen for you.
We are not responsible for outages, policy changes or decisions made by third-party platforms, such as a search engine or AI tool changing how it treats your site.
9. Confidentiality and data protection
We keep your business information confidential and only use it to deliver your work. How we handle personal data is explained in our privacy policy. Where we process personal data on your behalf, for example customer enquiries handled by a chatbot or receptionist we build for you, we act as your processor and will sign a data processing agreement with you on request.
10. Limitation of liability
Our total liability to you for anything arising from a service is limited to the fees you paid us for that service. We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or data. Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence.
11. Ending a service
You can cancel a monthly plan as described in section 3. We may stop work if a payment fails or if these terms are seriously broken, and we will tell you in writing first and give you a fair chance to put it right. If a project ends early, we hand over the work completed so far.
12. Changes to these terms
We may update these terms from time to time. The version on this page on the day you pay applies to that purchase. For monthly plans, we will tell you about any change at least 30 days before it applies.
13. Governing law
These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction over any dispute. If you are a consumer living elsewhere in the EU, you keep any protection the law of your country gives you. Before anything formal, please email us: most problems are sorted quickly by talking.
